Keeping Your Child's Best Interests in Mind
Child custody battles can be heartbreaking. Learning to share your child with you ex-spouse can be stressful for both you and your child.
I am a divorced mother with two young children. In my divorce, my experience with custody settlements carried with it the same emotions and frustrations you are experiencing right now.
When you want an attorney who understands your needs and your child's rights, contact The Law Offices of Candace L. Dick.
The Guiding Principle in Custody Battles is the Rights of the Child
When determining custody the ultimate goal is for both parents to be a part of the child's life. Accordingly, when possible, parents will have joint custody. Before filing for divorce, you should write down how much time you and your spouse spend with your child. Your contribution to this "time diary" will be beneficial when determining primary caregiver status.
Moving Out of State
During the custody process it is important that neither parent move out of state with the child, without the written consent of the other parent. Likewise, if you move to a different state without the child, it does not reflect well upon you, because it will reduce the amount of time you get to spend with your child. It is best to be sure of where you plan to live prior to filing for divorce.
Modifying Child Custody
Custody plans are never set in stone. Should a situation occur where child custody plans need to be altered, I can help. Modifications can be sought as the result of any substantial change in circumstances. Common changes include:
- Parent moves to a new state
- Parent gets a new job and time to spend with child changes
- Parent moves in with a new significant other
- Child is older and has different needs
If your circumstances have changed, necessitating a modification to your child custody plan, contact me about filing the paperwork for child custody modification.
