Six Things You Should Do/Know Before Getting a Divorce
1. Couples should attend marriage counseling before they file for divorce with an attorney. I offer legal advice, but I am not a trained counselor. You should be sure of your decision to divorce before coming to me for legal guidance.
2. Talk to a lawyer before you do anything. Even if you don't end up hiring a lawyer to handle your separation or divorce, you should get as much information as you can before you even discuss divorce with your spouse.
3. Take steps to protect your assets. One of these steps is to take possession of certain assets during separation, such as furniture and vehicles, and those assets that might be liquidated by your spouse.
4. Before filing a Complaint for divorce, you must determine whether you have lived in the State of Nebraska for more than one year. If you have not, you can file a Complaint for legal separation and convert that action into a divorce once you have met the residency requirement.
5. You may be entitled to alimony. If you can show a long-standing dependence on your spouse's income and have little earning potential after the divorce, you may be entitled to receive spousal support.
6. Before a divorce becomes final, you can receive temporary orders regarding child support and child custody. These orders are in place while everything else is being worked out between the parties. I will schedule a Temporary Hearing for you by filing a "Motion for Temporary Custody and/or Allowances".
